Safa Western Cape’s Modipa, Tyhawana and Konstabel found guilty of Contempt of Court!

The plot thickens!

This comes after Judge Pather in the Cape High Court found Safa Western Cape chairman Tankiso Modipa, his deputy, Chris Tyhawana and the secretary Nadia Konstabel guilty of contempt of court.

This follows an order made by Njokweni AJ in the Western Cape Division on 17 October 2025. The province were indicted from continuing with the Nedbank playoffs after Santos were excluded, until such time a Safa arbitrator determines the legality of Santos ‘s exclusion.

The rule nisi issued on 28 October by Barends AJ is against Safa WC, who was the second respondent along with Modipa (sixth respondent), Tyhawana (seventh) and Konstabel (eighth). The Barends order is amended and reads as follows…

The second respondent, sixth, seventh and eighth respondents were all slapped with a R30 000 fine each which is suspended on condition they comply with the court order.

In an event they do breach the order, the applicant, Santos FC may approach the court on supplemented papers for an order that they pay the fine to the registrar in a period to be determined by the court.

Safa WC faces a huge legal bill because they were ordered to pay the lawyers of Santos.

The issue of the suspension of Santos will be addressed in an arbitration hearing. Safa WC did not follow any due process when they suspended Santos and will face an uphill battle with more legal costs waiting for them.
