CDFA caught between rock and hard place; elections null and void!

Cape District Football Association (CDFA) is caught between a rock and a hard place.

The guilty verdict of Wayne Jones, president of the CDFA and another member Ivan Willimas has subsequently cast doubt over the validity of their elections.

It came to light that Jones has been re-elected as president of the CDFA with Nathan Less the new secretary. This begs the question, if Jones was suspended from all duties, how is it possible for him to be present at any of the LFA’s activities?

There also seems to be confusion as to who the actual secretary is as both Less and his ‘predecessor’ Grant Adams have subsequently sent out correspondence on the LFA’s behalf.

Our website can also divulge that the CDFA will have to appear in front of the DC – set for January 10th, 2024 – as to why they went ahead with their election.

No bones with Jones are in possession of the minutes of the executive meeting held on 3 July 2023 at the William Herbert Sports Complex which noted that Jones was present at the meeting while he was still under suspension by Safa Cape Town.

The opening line of the minutes reads: The President welcomed all present and introduced the new Executive team to Mark Lindon, who was noted as a guest on the minutes.

It goes further: “Mark Lindon presented the second draft of the annual financial statements (AFS) with specific attention to the changes as per decisions at the AGM. Discussion ensued and all comments and queries were dealt with leading to the approval and sign-off of the AFS. Letter of re-appointment of Mark Lindon as auditor for the ensuing year to be sent off. At this point the Chairperson thanked Mark Lindon for his attendance, and he left the meeting.”

Safa CT has subsequently made the ruling known of the case against Jones. According to the outcome Jones was found guilty and was ordered to apologise to the president of Safa CT, Bennett Bailey within 14 days. If he does not, he will be suspended for the whole of 2024. 

This further complicates matters, because Jones has already been re-elected as president.

These developments came after Jones and Williams brought the Association into disrepute by refusing to obey the instructions of the Chairperson of the meeting when ordered to, on the 5th of February 2023 at the AGM earlier this year.

The CDFA submitted the credentials of Wayne Jones and Ivan Williams as the delegates of the LFA to the meeting. It was alleged that Mr Williams got up shortly after the Approval of the Credentials of delegates and objected to the status of the meeting that he wanted to raise a Motion, which had to be tabled thirty (30) days before the commencement of the AGM.

The President refused to listen to his motion, and he had to sit down; He subsequently refused the order by the President who asked him to leave the meeting, whereto he refused. Mr Jones then took the mic and objected to the actions and behaviour of the President who asked him to leave as well, after he allegedly defamed and insulted the President.

The meeting was adjourned for five minutes so both delegates could leave. After the meeting reconvened, the two members still refused to leave and the meeting was again adjourned whereby the REC met and decided that should the members refuse to leave, SAPS will be called to remove the members.

Mr Clive Bailey addressed the Congress and asked the members to leave.  A vote was taken to decide whether the members should leave and the Regional Executive Committee and MANCOM decided it would be best if the meeting is adjourned to a later date.

It was alleged that the respondents have violated SAFACT Statutes, SAFACT Regional Standing Orders, CDFA Code of Ethics, CDFA Statutes and FIFA Code of Ethics; they also failed to promote friendly relations with SAFA Cape Town when they brought the SAFA Cape Town Annual Congress to an abrupt end, causing wasteful expenditure to be incurred. They also failed to observe the Statutes of SAFA Cape Town when ordered to leave the Annual Congress on 5th February 2023.
