A potentially significant legal battle is looming at the Rygate Local Football Association (LFA), with implications that could extend to the association’s governance, disciplinary processes and leadership.
No Bones with Jones has seen court documents indicating that De Goods Let’s Play Enterprises (DGPE), a club formerly affiliated to the Rygate LFA, has launched legal proceedings challenging its expulsion from the association in April this year.
The matter is scheduled to be heard in the Western Cape High Court on 23 October, where the circumstances surrounding the club’s removal are expected to come under scrutiny.
Sources have informed No Bones with Jones that officials from the Sheriff’s Office attempted to serve legal documents on Rygate LFA president Abdul Tajoodien on Saturday. It is alleged that the documents were not accepted at the time.
According to information received by this publication, correspondence relating to the matter was subsequently forwarded to the Rygate LFA office manager, while copies of the court papers were also reportedly emailed to Tajoodien.
DGPE is asking the court to examine whether its expulsion was carried out in accordance with the association’s constitution, disciplinary procedures and the principles of procedural fairness.
Should the court rule in favour of DGPE, the association could face a substantial legal bill, reportedly in excess of R100 000, in addition to any further relief that may be granted.
With the hearing date approaching, attention is likely to focus on the High Court proceedings as a dispute that has largely unfolded behind the scenes moves into the public arena.
Responding to questions from No Bones with Jones, Tajoodien said: “As this is a legal matter, the Association believes it would be inappropriate to discuss the details publicly while the matter is being addressed through the appropriate channels. We remain committed to respecting due process, the relevant legal procedures, and the rights of all parties involved.”
